Rule 42
The Attorney General may give directions or delegate authority;
(1) The Attorney General can give the necessary instructions to make the investigation and prosecution of the case in which the Government of Nepal is the plaintiff effective, and it will be the duty of the concerned officials and public prosecutors to comply with such instructions.
(2) Subject to the prevailing law, it shall be the duty of the concerned officer to comply with the instructions given by the Attorney General in cases or legal matters in which the rights, interests or concerns of the Government of Nepal lie.
(3) The Attorney General or Head of Department, subject to the prevailing law, may delegate some of his/her powers as needed to be exercised and followed by the public prosecutor under him/her.
